These Terms of Service ("Terms") are a binding legal agreement between you and Peekd ("we", "us", "our") governing your access to and use of the Peekd website, dashboard, tracking links, APIs, and all related services (collectively, the "Service"). By creating an account or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and account
You must be at least 16 years old and legally capable of entering into a binding contract to use Peekd. You are responsible for all activity that occurs under your account, including keeping your login credentials secure and confidential. Notify us immediately at
support@peekd.link if you suspect unauthorized access to your account.
You must provide accurate registration information and keep it up to date. One person or entity may not maintain multiple accounts for any reason.
2. The Service
Peekd is a link-tracking tool that wraps a destination URL with a unique short tracking link. When that tracking link is opened, we log the event and notify you. We do not guarantee that every open event is captured โ certain email clients, browser extensions, or network configurations may prevent tracking. We also do not guarantee that destination URLs remain valid after a link is created. The Service is provided on a continuous-improvement basis and features may change without notice.
3. Acceptable use
You agree
not to use the Service to:
- Send spam, distribute phishing content, malware, or links to illegal material.
- Disguise or misrepresent the destination of a tracking link in any deceptive or unlawful way.
- Wrap URLs you do not have the right to share or distribute.
- Track individuals without a lawful basis or in violation of applicable privacy laws โ you are the data controller for the open events generated by your own links.
- Harass, defraud, impersonate, or harm any person or entity.
- Probe, scan, scrape, reverse-engineer, brute-force, or enumerate tracking identifiers belonging to other users.
- Run automated scripts, click farms, headless browsers, or any tool designed to artificially inflate or deflate open counts or tamper with analytics.
- Attempt to circumvent rate limits, access controls, or any security or abuse-prevention measure.
- Resell, sublicense, or provide third-party access to the Service without our prior written permission.
- Interfere with or disrupt the integrity, performance, or infrastructure of the Service.
We may suspend or terminate accounts, disable tracking links, throttle requests, or take any other action we deem necessary to protect the Service or its users โ at our sole discretion and without prior notice when circumstances require it.
4. Free-tier integrity and anti-abuse
The free tier is offered to allow individuals to evaluate Peekd. To keep it fair and sustainable, you agree to the following:
One account per person and per business. Creating multiple free accounts โ including by using disposable, aliased, plus-addressed, or temporary email addresses, separate browsers, VPNs, virtual machines, or any other method โ to exceed free-tier limits is a material breach of these Terms and will result in termination of all associated accounts.
No counter manipulation. Deleting and recreating links, rotating accounts, or using any other technique to reset or circumvent free-tier counters is prohibited.
No fake opens. Generating artificial open events through automated tools, click farms, or any other method is prohibited and may result in immediate account termination.
No sharing or pooling. Sharing, transferring, or pooling a paid subscription across multiple unrelated individuals or businesses is prohibited.
The free tier limit is based on the total number of links created under your account, including deleted links. Deleting a link does not restore your free-tier allowance.
We employ technical controls โ including per-IP rate limiting, duplicate-open suppression, device fingerprinting, and link-deletion pattern analysis โ to enforce these rules. Violations may result in immediate suspension, forfeiture of any pre-paid fees, deletion of data, and reporting to law enforcement where appropriate.
Fair use policy. Where a plan is described as offering "unlimited" tracked links, that means unlimited for normal individual or small-business use. To protect the Service against abuse, spam, and automated misuse, unlimited usage is subject to a fair-use threshold of 1,000 newly created tracking links per account per calendar month, plus reasonable limits on request rate, storage, and email volume. If your usage materially exceeds normal use or the fair-use threshold, we may contact you, apply rate limits, require an upgrade to a higher plan, or suspend the account. We may adjust these thresholds from time to time with notice on this page.
5. Subscriptions, billing, and refunds
Paid plans are billed in advance through our payment processor, which acts as Merchant of Record and handles all billing, tax, and compliance obligations on our behalf. By subscribing, you authorize recurring charges at the interval you selected (monthly or yearly) until you cancel.
You must cancel before your next automatic renewal date if you do not want the next charge. Cancellations take effect at the end of the current billing period. We do not pro-rate partial periods or issue credits for unused subscription time.
All fees are final and non-refundable, including where you forget to cancel before renewal, stop using the Service, downgrade your plan, cancel after payment has been collected, or no longer require the Service. Exceptions apply only where required by applicable consumer protection law.
We may change pricing with at least 30 days' advance notice. Existing subscribers will retain their current rate until the next renewal.
6. Downgrade policy
If your paid subscription ends, is canceled, becomes past due, is subject to a chargeback, or otherwise lapses, your account automatically reverts to the free plan. At that point, free-plan limits apply immediately: only the five most recently created tracking links in your account remain active. Older links may be deactivated and will no longer redirect or log open events. You may reactivate them by upgrading to a paid plan. This policy exists to prevent users from creating large numbers of paid links and continuing to use them after downgrading.
7. Your content
You retain all ownership of the URLs, labels, and content you submit to the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit that content solely as necessary to operate the Service. You represent and warrant that you have all rights necessary to share the content you submit and that doing so does not violate any law or third-party right.
8. Intellectual property
The Peekd name, logo, website, dashboard, source code, and all related materials are owned by us and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership to you. You may not copy, modify, distribute, reverse-engineer, or create derivative works of the Service or any part of it.
9. Privacy
Our
Privacy Policy governs how we collect and handle data. By using the Service, you acknowledge and agree to its terms.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR THAT EVERY OPEN EVENT WILL BE CAPTURED OR DELIVERED. EMAIL NOTIFICATION DELIVERY DEPENDS ON THIRD-PARTY INFRASTRUCTURE OUTSIDE OUR CONTROL.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PEEKD, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
12. Indemnification
You agree to defend, indemnify, and hold harmless Peekd and its affiliates, officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or any applicable law.
13. Termination
You may stop using the Service at any time by deleting your account. We may suspend or terminate your access immediately if we believe you have violated these Terms, created legal exposure for us, or if we discontinue the Service. Provisions that by their nature should survive termination โ including intellectual property, disclaimers, limitation of liability, indemnification, and governing law โ will survive.
14. Governing law and disputes
These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding individual arbitration or, where arbitration is not permitted, in a court of competent jurisdiction. You waive any right to participate in a class action or class-wide proceeding to the extent permitted by law.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
16. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Peekd regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
